Possession of drugs in Poland

A prison sentence is provided for this offence, although it need not be imposed in every case.

Possession of drugs is one of the more common offences in Poland. Young people are often caught without realising the consequences. A possible prison sentence is not the only concern: an entry in the National Criminal Register, known as the KRK, may also affect your ability to apply for certain jobs in the future and disrupt your career plans.

You should know, however, that a range of outcomes may be possible, from discontinuation of criminal proceedings and conditional discontinuation to voluntary submission to punishment and, in rare cases, acquittal of the alleged offence. Which outcome to pursue depends, of course, on the circumstances of the particular case. Police officers also sometimes make mistakes that can be used to change the course of a case or minimise the consequences of possessing illegal drugs and substances.

After you instruct me to handle your case:

1. I take over contact with the law enforcement authorities (the police and prosecutor's office).
2. I request access to the case file and analyse it thoroughly.
3. I check whether the evidence supports requesting an expert opinion on the exact substance, its quality, how many portions it could provide and how many people it could intoxicate (all of which may significantly affect the potential sentence).
4. I develop a strategy and propose the best solution for your situation.
5. I accompany you during steps in the preparatory proceedings (such as questioning by the police or prosecutor) and during court hearings.
6. I prepare the relevant documents and file complaints or other appeals.
